1. Acceptance of Terms

By accessing, browsing, or using the official website (www.pineguards.com), the Pine Security Client Portal ("Infinity"), or any services offered by Pine Security Service Pvt Ltd ("Pine Security," "Pine India," "we," "us," or "our"), you agree to be legally bound by these Terms and Conditions ("Terms"). These Terms apply to all users, including but not limited to clients, vendors, contractors, personnel, and visitors.

If you do not agree to these Terms in full or in part, you must immediately discontinue access to the website, refrain from logging into the Infinity portal, and cease the use of our services.

• Binding Agreement: These Terms constitute a legally binding agreement between you and Pine Security, governing your access and use of all associated platforms and services.
• Updates & Changes: We reserve the right to modify or update these Terms at any time. Continued use of our platforms or services after such changes constitutes your acceptance of the revised Terms.
• Supplementary Agreements: For clients and vendors, these Terms are supplemented by individual service agreements, SLAs (Service Level Agreements), NDAs (Non-Disclosure Agreements), and onboarding documentation where applicable.
• Platform-Specific Terms: Use of the Infinity Portal is also governed by specific operational protocols and data security policies. Separate terms may be displayed at the time of login or registration.
• Jurisdiction: These Terms are governed by and interpreted in accordance with Indian law. Any disputes arising from the use of our platforms or services shall be subject to the jurisdiction of courts located in Bathinda, Punjab, India.

Note: You are advised to review these Terms periodically for any changes. Pine Security may notify users of significant changes via email or platform notifications.

2. Scope of Services

These Terms govern the access and use of various offerings provided by Pine Security Service Pvt Ltd. Our services are designed for individuals, organizations, and businesses seeking professional-grade security solutions, digital infrastructure, and administrative tools through web and portal platforms.

• Website: Serves as a public-facing platform to provide company information, list services, facilitate contact forms, publish legal documents, and post announcements or updates relevant to clients and stakeholders.
• Infinity Portal: A secure, login-based web portal designed for authorized clients. It allows real-time access to guard deployment schedules, attendance reports, incident tracking, digital invoices, service documentation, and support ticket submissions.
• Security Services: Encompasses the physical deployment of trained guards, patrolling units, access control management, event security, emergency alert systems, and related logistical support tailored to residential, industrial, or commercial premises.
• CCTV Monitoring: Includes real-time monitoring of surveillance feeds, incident detection, automated alert escalation, evidence archiving, integration with control room operations, and data submission for law enforcement upon request.
• Manpower Services: Provision of skilled and semi-skilled personnel including:

Pine Security may enhance, modify, or discontinue specific service modules at its discretion, with prior notice to impacted users wherever feasible.

3. User Responsibilities

Users accessing the Pine Security website, Infinity portal, or any related services agree to follow responsible usage practices and comply with all applicable laws, platform rules, and contractual obligations. These responsibilities ensure operational integrity, data protection, and mutual trust.

• Maintain confidentiality of login credentials for portal access and avoid sharing them with unauthorized individuals
• Use the website, portal, and services only for lawful purposes in accordance with Indian laws and company policies
• Refrain from tampering with or attempting unauthorized access to website code, databases, servers, APIs, or security systems
• Promptly report any suspected vulnerabilities, misuse, data breaches, or suspicious activity through official communication channels
• Ensure accurate information is provided while filling out forms, reports, complaints, or onboarding documents
• Respect privacy, confidentiality, and intellectual property of Pine Security, its clients, and its personnel
• Do not upload or transmit malicious software, files, or links through any Pine Security platform
• Cooperate during audits, investigations, or compliance checks initiated by Pine Security or regulatory authorities
• Avoid impersonation or misrepresentation of identity while interacting with any digital service or physical deployment

Important: Failure to comply with these responsibilities may result in account suspension, legal action, and/or termination of services.

4. Intellectual Property

All content, branding, trademarks, service marks, software code, text, graphics, layouts, icons, photos, videos, documentation, and any other materials made available on the Pine Security website, Infinity portal, or through its services are the exclusive intellectual property of Pine Security Service Pvt Ltd, unless otherwise stated.

• Logos, slogans, and trade names associated with Pine Security are protected under applicable trademark laws
• Custom software and interfaces used in Infinity portal are proprietary and licensed for client use only
• Any unauthorized copying, reproduction, modification, resale, or distribution of materials is strictly prohibited
• Users are not permitted to reverse-engineer, decompile, or disassemble any part of the Pine Security platform or technology stack
• Third-party logos, tools, or content (if any) used on the platform are acknowledged and remain the property of their respective owners
• Pine Security reserves the right to pursue legal action against individuals or entities that infringe upon its intellectual property rights

Note: Use of Pine Security's content, branding, or assets for media, marketing, or partnerships must be authorized in writing.

5. Service Limitations & Downtime

While we strive for 99.9% uptime on digital platforms, occasional maintenance, upgrades, or unexpected technical issues may result in temporary disruptions to the website, Infinity portal, or related systems. Pine Security is not liable for any direct, indirect, incidental, or consequential losses incurred due to such downtime, whether planned or unplanned.

The Infinity Portal may also display advertisements or sponsored content powered by Google AdSense or similar providers. These ads help support platform development and operational costs. Users acknowledge that:

• Ads displayed are subject to Google's advertising policies and algorithms
• Pine Security does not personally endorse third-party products or services shown via these ads
• User interaction with these ads is at their own discretion and risk
• Pine Security is not responsible for the content, accuracy, or behavior of third-party advertisers

Note: Users can manage their personalized ad preferences directly via their Google account settings.

6. Termination

We reserve the right to suspend or terminate access to any of our services or platforms—including website, Infinity portal, or field services—for any of the following reasons:

• Violation of these terms or applicable law
• Non-payment of dues or breach of service agreements
• Abusive, fraudulent, or disruptive behavior
• Security threats or unauthorized access attempts

Upon termination, users may lose access to stored data or historical records unless otherwise stated in a formal agreement.

7. Limitation of Liability

Pine Security shall not be held responsible for any direct, indirect, incidental, or consequential damages arising out of:

• Misuse or unauthorized access to services or systems
• External breaches or cyber attacks beyond our reasonable control
• Inaccurate data provided by clients, users, or third parties
• Decisions made by users based on advisory content or reports

In any event, Pine Security’s total liability shall not exceed the fees paid by the user for the specific service in question, within the last 12 months of active service.

8. Legal Compliance

Pine Security is committed to compliance with all applicable Indian laws, including but not limited to:

• Information Technology Act, 2000 and relevant amendments
• Digital Personal Data Protection Act (DPDPA), 2023
• Private Security Agencies Regulation Act (PSARA), 2005
• Indian labor laws, taxation, and employment regulations

Our policies and platform operations are periodically reviewed to ensure ongoing adherence to legal and regulatory requirements.

9. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes, claims, or legal proceedings arising out of or relating to the use of Pine Security's services or platforms shall fall under the exclusive jurisdiction of the competent courts located in Bathinda, Punjab.

Both parties agree to make reasonable efforts to resolve disputes amicably through written communication before initiating formal legal action.
